Topic: What would you use as TLD ? .com .fr .eu .ro

I become associate with one ex-client. He want to invest in a Matchmaker agency about 50 000 euro. I own 75% and he has 25% from the society.

I am developping an europeen trademark in dating service for serious long therm relationships and marriage, at the beginning, between romanian woman and french men. Then I will extend.

I hesitate what TLDS should I promote  .com .fr .eu .ro  for better ranking and success ?

(UPDATE : I got the .com domain here below on April 2012 )

The trademark is registered by my society since 2010. The domain matrimo.com is taken by someone since 1999. This .com domain is not used, but it is redirected to a dating site as affiliate. It has about 10 visits a day. I tryed to buy it but the owner refuse to sell it.

Anyway i think he can not use iti anymore because the word from the domain name is my registered mark. What do you advise me to do ?

If the domain name was in use before you registered your trademark you are not likely to have much success trying to obtain it except by buying it. If they refuse to sell I think there is not much you can do about it.
Try to find a .com name that is close to the name you want, or then a .eu. For most a .com is always the most easily recognised and most desirable.

My friend had the same issue. Domain was registered 5 years before my friend`s trademark, and he could do nothing about it. But, domain owner sold him domain for 3000 eur...

Mcp, Mcsa, Mcse, A+, Server+, Linux CP...

Thank you for your replay

He can use it all day and night as long as he bought it before you did the trademark. Move on and find another trademark.

I am not sure of that.

When you take/pay a domain name, the domain is not yours. You just rent the right to use it.

A trademark is POWERFULL ans it is YOURS exclusively. Nowboy else can use that word, i am almost sure.

Now there are millions of domains registered. So do not tell me that now body will registered similar trademarks as those domain names.

I consulted some cases of jurisprudence ..... A trade mark is UP to domain names. Even someone can own a domain name and he do not want sell it, he can not use it anymore since the word become a trademark.

Am I right ?

you have maybe right and maybe wrong but have you so much money so you can start a legal process.

Prepare yourself for higher costs if you will do a lawful process of this ! it costs probably more than it tastes !
I am pretty sure you will lose if he took the domain name before you started your site, so you can not win this,
and as long as he pays for the renewal of their domain name he owns the rights to use it.

I have just asked my lawyer and he confirms what I tell you.

example: if he lives in usa and you live in romania you have very likely one more problems smile
what country are you going to process with this ? "what domain holder" it is in usa or it is in your country ?
I think you understand that I mean you must be there personally then they process about this !

my advice is forget the .com address and obtain a new domain address instead !

Lets say he will not want to sell the domain name to me. OK he can keep it. I repeat, he do not win money from that domain. He is a simple affiliate and get maybe 10 visitors/day.

But as I have the trademark he will can not use that domain name anymore. Am i right ? He has no protection, no excusive right to use that word.

I will can oblige him to stop using that word / domain name... even he registered the domain before my trademark. The domain name policy, give you a rent right not a property right on domains.

I own the domain  .fr and .eu, it is enough for the moment, i think. My new society has the same name as my trademark.

I think in a court you would have problems, as he was using the domain before you registered your trademark. He was using it before you and would have rights to use it. If you are serious you would need to consult a lawyer familiar with such internet problems. And where he is based makes a difference too, if he is outside the country or regions you registered the trademark in then that trademark law may not apply to him.

I agree ... I only use .se and .eu domains smile all .com domains is taken even if they don´t use them ...
or redirect them to other sites ... but unfortunately it has become so on the Internet today ... sadly ...
so rombest keep up your good work with your site/sites ... and don´t think about this anymore ...

Wish I had better news for you, but it doesn't look good. The owner of the domain is allowed to do just about anything he wants. He can certainly continue to do what he was doing prior to your trademark filing. Had he tried to contact you to buy the domain from him, he would have been shown in 'bad faith', and you might have had a case, but you contacted him, so that rules that out. Sadly there isn't much you can do except trying to get him to sell. If you're having a difficult time reaching him, you might want to check and see if the domain is listed on any domain auction sites like sedo or afternic. It's a long shot, but you never know. Nothing wrong with using other extensions though! but there is a risk of users trying to access your site, but going to his instead.

I think you are wrong.

The owner of the domain is NOT allowed to do just about anything he wants, if the domain name represents a Registered Trademark.

As prouve .... his site was turned off now by the hosting company. This is a positive sign.

Also, he can not sell it. SEDO say "  It is completely legal to trade domains as long as the domain being sold does not infringe on the trademark rights of a third party. Domain name sellers should be aware that it is their responsibility to ensure that their domain name is free from possible trademark infringements before listing it for sale. Ignorance of the law is no excuse! "

In my previous answerd i wrote : "As prouve .... his site was turned off now by the hosting company. This is a positive sign."

Yesterday the owner on the domain moved the domain to NS1.FASTPARK.NET, hosted by namedrive.com

Today in the afternoon, we sent a Trademark Claim to Name Drive according to their Infringement Notification Policy.

Only 3 hours after that we sent the complain, the site was put Offline, : "This domain has been blocked"

So, as this is the second time in 5 days that the domain name was bloked  because it represents a trademark, i am sure that the owner will never be able to use it.

So the best choice for him is to sell us the domain for a normal price.

So, yes my friends, the trademak are protected by international laws, more then any domain names.

First of all - a trademark is limited to a specific group (kind of business). That means: There can be two or more trademarks called "apple". One is registered for the IT-business, anotherone can be registered for selling fruits...

2nd: A trademark is also limited to a country. That means, that there could be a "apple" for the IT-business in the US and a "apple" for the IT-business in the UK.

So you need to be registered for "apple" in the IT-business wordwide.... That registration fee is a hell of money.... and still there could the the trademark for "apple" in the fruit-business. The only rule is: Your company name or logo is not allowed to confuse the visitors. That means that the fruit-man is allowed to use an apple as a logo too, BUT it has to have other colours and shape...

3rd: there can be "apple" trademarks for grafics and sounds. An acoustic trademark can be slogan or jingle in the radio....

The problem is: there is only one .com domain. So, the 2nd registrar has to use another domain-ending like .us, .info or so. 1st come --> 1st served...

Further on: Imagine, Mercedes-Benz or any other company is using their-company-name.com but they did not register the trademark. Now YOU register the trademark for this business. Try to prohibit Mercedes-Benz to use that name any longer and to give you the domain...

I wish you good luck to get the domain or to convice the owner to sell it... but I would look for a similar domain name...

UPDATE : As I allready said in another topic, I finally got the domain that I wanted, the domain who represents the name of my trademark, the name of my company, : matrimo.com
